Music Societies Licence Agreement

Universities Australia (formerly the Australian Vice-Chancellors Committee (AVCC)) signed a new Music Licence Agreement in 2005 with the Music Societies AMCOS & APRA; ARIA; and PPCA. CQUniversity is a party to this agreement, along with most Australian Universities.

Under the agreement CQUniversity will be able to reproduce, communicate and perform an extensive repertoire of musical works without having to obtain prior permission of copyright holders.

Finding music owners:
If the record label/producer of the music you want to use is not on this list, you will have to seek permission from the copyright owners before you can use it. Check the Works Search facility on the APRA website or try searching on the Australian National Library's Music Australia site or Australian Music Online.

What the agreement covers:

N.B. Musical works covered by this agreement must be made from legitimately purchased CDs (or tapes, vinyl albums, DVDs). Digital format music downloaded from iTunes, Bigpond, or other internet service providers is not covered by this agreement.

Making Audio recordings

CQUniversity can make audio recordings of copyright music/sound for education purposes, provided they are:

  • intended to be played at University event;
  • of a University Event; or
  • for analysis by students in a course.

Making Video recordings

CQUniversity can make video recordings which include copyright music/sound for education purposes, provided they are:

  • of a University Event; or
  • made by students as part of a course and are only played at a University Event.

Performances

CQUniversity Staff and Students may perform copyright music:

  • for educational purposes, i.e. in a course;
  • at a University Event; or
  • for the sole benefit of employees of CQUniversity in the workplace.

Making recordings of University Events

CQUniversity can make an audio or video recording of a University Event at which copyright music/sound is played or performed.

Copies of Recordings

Copies of recordings can be made for students or staff of CQUniversity, strictly for their own private or domestic purposes, at no cost, or for cost-recovery only.

A copy may be held in the archives for access by staff and students only.
A copy may be made available on an intranet (through Course Resources Online only).
Recordings may not include any advertising or promotion material.

Music on hold

Telephone systems throughout the University may play music on hold.

What the agreement does NOT cover:

Ripping or burning CDs etc.

This agreement does NOT give staff or students permission to make infringing copies of music or sound recordings. You cannot burn copies for your friends or distribute copies of music via the internet.

Associated copyright material

This agreement does not allow you to reproduce any cinematograph film or video; or any literary, dramatic or artistic work associated with a musical work or sound recording. This includes lyrics and video clips of songs. (However, you may tape music videos off television under the Screenrights Licence (Part VA) .)

Photocopying Print Music

This licence does NOT cover photocopying print music.
Limited reproduction of print music may be done under the CAL Print & Graphic Licence (Part VB) , that is: you may only photocopy or communicate up to 10% of a musical work for educational purposes, unless the work is unavailable within a reasonable time at an ordinary commercial price, or is not separately published; otherwise permission must be obtained from the relevant copyright owner(s). Music outside the societies' repertoire

It should be noted that this is not a blanket licence which covers all music and sound recordings. It only covers those produced by society members, which fortunately is very broad, but you will need to check the appendices of the agreement to be sure.

Digital format music downloads

Music downloaded from iTunes, Bigpond, or other internet service providers is not covered by this agreement, as the music purchased from these services is covered by the terms and conditions of their licensing which is for personal use only.

Student Association Functions/Facilities

The Student Association is not covered by this agreement. It is responsible for its own arrangements with APRA to cover the playing or performance of music at union facilities on campus. This would include music played in university bars, refectories, cafes and fitness centres.

Performances in public

This agreement does not include performing in public music/sound recordings at any event or occasion where a fee for entry is charged; nor does it cover any use of CQUniversity premises for other than for the Educational Purposes of CQUniversity.

Performing Arts students

This agreement does not include doing performances or making video recordings of performances of the following:

  • a Grand Right Work or excerpts of that work (this includes any opera, operetta, musical play, ballet, review or pantomime to the extent that it consists of words and music written expressly for it);
  • Musical works and associated words composed for a ballet if that performance is accompanied by a visual representation of that ballet or excerpts of that ballet;
  • a Choral Work of more than 20 minutes' duration or excerpts of that Choral Work;
  • a musical work or excerpts of that work performed in a Dramatic Context.

This file is not available for download, and no further copies may be made or distributed.

Moral Rights

This agreement does not provide permission to perform any music and associated words so as to burlesque or parody the work; or perform any musical work with new or substituted lyrics, or any lyrics which have been notified by APRA as prohibited.

Surveying

Each year, CQUniversity will be required to provide a snapshot of sound recordings held on IT systems in Central Units as at 1 October for the relevant calendar year.

Data will be collected on sound recordings copied and communicated in reliance on this Agreement and held on Participating University IT systems in Central Units.

For this purpose, it will be necessary to create a central resource or facility for the electronic copying, storage and communication, in reliance on this Music Licence, of sound recordings for all of the university. It is anticipated that this will be provided through the Library's central registration of copyright, in a similar approach to Course Resource Online (CRO). Further information will be provided when a procedure has been established.
