Smoking in the Workplace

 

CQUniversity campuses are bound by state legislation that concern smoking in the workplace. Over a number of years the Queensland State Government has introduced various amendments to the Tobacco and Other Smoking Products Act 1998 which outlined new requirements in relation to smoking:

 

Current requirements

  • No-smoking anywhere inside pubs, clubs, restaurants and workplaces.
  • No-smoking in commercial outdoor eating or drinking areas.
  • No-smoking in outdoor public places such as patrolled beaches, children’s playground equipment, major sporting stadiums and within 4 metres of non-residential building entrances.
  • No sale of tobacco products to children under 18 years of age.
  • Mandatory training of employees who sell tobacco.
  • Mandatory no-smoking and quit smoking signs.
  • Restrictions on how tobacco products can be displayed at retail outlets.
  • No tobacco advertising or competitions.
  • Tobacco vending machines must be located in bar or poker machine areas only.

On 26 May 2008 additional changes were made which include:

  • A ban on smoking in cars where children under the age of 16 years are present.
  • A transfer of power to local government to regulate smoking at pedestrian malls and public transport waiting points such as bus stops, taxi ranks and ferry wharves.

 

Non-liquor licensed food or drink businesses

Since July 2006 all outdoor eating and drinking areas where food or drink is provided as part of a business must be no-smoking. This general rule applies to all businesses, and some examples of such areas at CQUniversity are shown below:

Fines

A number of offences under Queensland's Tobacco Laws are enforced by on-the-spot fines.

 

CQUniversity Policy

In May 2011 the updated ‘Smoking in the Workplace’ policy was introduced by CQUniversity, reflecting the current smoking requirements of Queensland State Legislation - CQUniversity Smoking Policy.
